These Terms and Conditions ("Terms") govern your access to and use of the Savvyly website, software platform and services (collectively, the "Services"), provided by:

Savvyly is a technology vendor. We build software platforms that are operated by, and on behalf of, licensed financial services entities. We do not provide financial advice, intermediary services, deposit-taking, lending or payments in our own right.
2. Acceptance of Terms
By accessing or using the Services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Services.
3. Services
Savvyly provides:
- A Banking-SaaS platform licensed to licensed cooperative financial institutions and community stokvels;
- A portfolio of Agentic AI productivity tools available to individual subscribers as software products only.
Specific features, pricing and service levels are described in the relevant order form, subscription agreement or product description.
4. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
5. Subscriptions and Fees
Where the Services are provided on a subscription or licence-fee basis, fees, billing cycles and payment terms are set out at the point of purchase or in your service agreement. Subscriptions are billed in advance, in South African Rand (ZAR), inclusive of VAT where applicable, and renew automatically at the end of each billing period unless cancelled in accordance with our Refunds & Cancellation Policy.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
- Reverse-engineer, decompile, copy or attempt to derive the source code of the Services;
- Interfere with or disrupt the integrity or performance of the Services;
- Use the Services to transmit malicious code, spam or harmful content;
- Attempt to gain unauthorised access to any part of the Services or associated systems.
7. Intellectual Property
All intellectual property rights in the Services — including software, content, designs, trademarks and documentation — belong to Savvyly or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. No other rights are granted, by implication or otherwise.
8. Privacy
Your use of the Services is also governed by our Privacy & POPIA Policy, which forms part of these Terms.
9. Disclaimers
The Services are provided "as is" and "as available". To the maximum extent permitted by law, Savvyly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
The Services do not constitute financial, legal or tax advice. Any financial activity facilitated by the platform is the responsibility of the appropriately licensed entity that operates it.
10. Limitation of Liability
To the maximum extent permitted by law, Savvyly will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill arising out of or in connection with your use of the Services.
Savvyly's aggregate liability under or in connection with these Terms in any twelve (12) month period will not exceed the total fees paid by you to Savvyly during that period. This cap does not apply to liability for gross negligence, wilful misconduct, fraud, or any liability that cannot be limited by law (including non-waivable rights under the Consumer Protection Act, 2008).
11. Termination
We may suspend or terminate your access to the Services if you breach these Terms or fail to pay applicable fees. You may terminate by following the cancellation process set out in our Refunds & Cancellation Policy.
12. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on this page with the effective date updated above. Material changes will be communicated to active subscribers.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa, and any dispute arising from or relating to them is subject to the exclusive jurisdiction of the South African courts.
